TERMS AND CONDITIONS OF SALE
Last updated: 23 Sept 2026
1. Definitions
These General Terms and Conditions of Sale ("Terms") govern the offer and sale of aim/handmadeinitaly products ("Products") on the website www.aimhandmadeinitaly.com (the "Website" or "Online Shop").
Products purchased on the Website are sold by AIM di AnnaMaria Mongillo, Via Giambattista Vico 33, 81100 Caserta (CE), Italy, VAT number 04930970613 ("Seller", "we", "us").
"Customer" means the individual or legal entity purchasing Products through the Website.
2. Scope and Acceptance
These Terms govern the relationship between the Customer and the Seller with regard to the purchase of Products offered on the Website.
The Seller may update these Terms at any time. The version published on the Website at the time an Order is placed will apply to that purchase. Where these Terms conflict with any other terms published in the Online Shop, the version more favourable to the Customer will apply.
Purchase agreements concluded through www.aimhandmadeinitaly.com are governed by Italian law, in particular Legislative Decree 9 April 2003, n. 70 (implementing Directive 2000/31/EC on electronic commerce) and Legislative Decree 6 September 2005, n. 206 (the Italian Consumer Code), as amended.
3. Account and Checkout
Customers may create an account to place Orders and manage their profile, or check out as a guest by providing their name, email address, delivery address, phone number, and payment details. Account holders are responsible for keeping their login credentials confidential and for all activity carried out under their account.
4. Placing an Order
Customers select Products and add them to the cart. Before completing the purchase, Customers must review the selected Products, the delivery details, and the total price (including any shipping costs), and select a payment method as set out in Article 8.
By submitting an Order, the Customer confirms that they have read and accepted these Terms, together with the Shipping Policy and the Return & Refund Policy published on the Website.
5. Conclusion of the Contract
The Seller will send an Order confirmation to the Customer by email within 3 working days of receiving the Order. The contract is concluded when the Customer receives this confirmation. If no confirmation is received within that period, the Order is to be considered rejected.
The Seller is not liable for delays or failures caused by the data transmission networks used to send or receive Order communications.
6. Product Availability
Product pages indicate whether an item is in stock. All Products are subject to availability, and product images are for illustrative purposes only; actual colour and finish may vary slightly, particularly given the handmade nature of the Products.
If a Product becomes unexpectedly unavailable after an Order is placed, the Seller will notify the Customer by email, propose an alternative where possible, and place a hold on any card payment. The Customer may confirm or amend the Order within 48 hours of that email; if no response is received, the Seller will proceed to ship the available Products only, and any amount paid for the unavailable Product will be refunded.
The Seller may change the range and availability of Products at any time without prior notice and without liability to Customers.
7. Price, Shipping Costs, Taxes and Duties
All prices are shown in Euro (€) and are those published on the Website at the time the Order is placed. VAT is included in the price for deliveries within the European Union.
Shipping costs are shown separately at checkout, before the Order is submitted, and are charged in addition to the price of the Products. Current shipping charges are set out in our Shipping Policy.
For deliveries outside the European Union, any customs duties, import taxes, or other charges imposed by the destination country are the Customer's responsibility and are not included in the price or shipping cost.
While the Seller takes reasonable care to ensure prices are accurate, errors may occur. If a pricing error is identified before an Order is shipped, the Seller will contact the Customer to confirm whether they wish to proceed at the correct price before completing the Order.
8. Payment
Customers may pay using the payment methods indicated at checkout.
Payment is processed at the time the Order is placed. Where an invoice is required, the Customer must provide their tax code (private customers) or VAT number (business customers) at checkout; invoice details cannot be changed once issued.
9. Right of Withdrawal (EU Consumers)
If you are a consumer resident in the European Union, you have the right to withdraw from your purchase within 14 days of receiving your Order, without giving any reason, in accordance with Directive 2011/83/EU and the Italian Consumer Code.
To exercise this right, contact us at [email protected] within the applicable window. Our Return & Refund Policy, which offers a 15 day return window, applies in addition to and extends beyond this statutory minimum.
10. Returns and Refunds
Returns, exchanges, and refunds are governed by our Return & Refund Policy, published on the Website, which forms part of these Terms.
11. Shipping and Delivery
Shipping and delivery terms, including transit times and delivery conditions, are governed by our Shipping Policy, published on the Website, which forms part of these Terms.
12. Legal Warranty of Conformity
Products sold to consumers within the European Union are covered by the legal warranty of conformity provided for under Articles 128 to 135 of the Italian Consumer Code, which applies for 2 years from delivery for defects existing at the time of delivery. This warranty is separate from, and in addition to, our Return & Refund Policy.
To make a claim under this warranty, contact us at [email protected] with your order number, a description of the defect, and supporting photos.
13. Intellectual Property
All intellectual property rights connected to the Website and its content, including trademarks, logos, text, and images, are the exclusive property of AIM di AnnaMaria Mongillo. 14. Errors and Inaccuracies

We reserve the right to correct such errors at any time, including after an Order has been submitted, and to update Website content without prior notice.
15. Limitation of Liability
To the fullest extent permitted by law, the Seller's liability for any claim arising from an Order is limited to the price paid for the relevant Products. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.
16. Force Majeure
The Seller is not liable for any delay or failure to perform its obligations where this is caused by circumstances beyond its reasonable control, including courier delays, natural events, strikes, or other disruptions.
17. Privacy and Personal Data
Personal data provided by Customers is processed in accordance with our Privacy Policy and Regulation (EU) 2016/679 (GDPR), as implemented in Italy by Legislative Decree 196/2003, as amended by Legislative Decree 101/2018.
18. Complaints and Online Dispute Resolution
Customers who are EU consumers may submit complaints directly to us at [email protected], or use the European Commission's Online Dispute Resolution (ODR) platform, available at https://ec.europa.eu/consumers/odr.
19. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
20. Governing Law and Jurisdiction
These Terms are governed by Italian law. For Customers acting as consumers resident in the European Union, this choice of law does not deprive them of the protection afforded by mandatory provisions of the law of their country of residence.
For any dispute not subject to mandatory consumer protection rules, the courts of Naples, Italy shall have exclusive jurisdiction.
